Mediation

To reduce the time and expense of litigation, our firm employs alternative means to resolve disputes and to promote early settlements.

Mediation can either be binding or facilitative. In binding mediation, an arbitrator is given authority to render a decision on the matter. In facilitative mediation, the parties are empowered to reach their own agreement. Mediation is effective when parties have reached an impasse or when there are personal conflicts, poor communication, imbalances of power or inflexible negotiating postures. It is informal and a fraction of the cost of a civil proceeding.

In this process, parties control the scope of their discussions and any agreement reached. A third party neutral generally assists in identifying and clarifying the issues. Andrew Bemish is a certified mediator in the State of Michigan and periodically volunteers his services at the Washtenaw County Dispute Resolution Center. As a qualified mediator, he can generally offer options for resolution and assist in crafting a settlement agreement.
